A Factory

A factory is defined by any premise that operates machinery equivalent to five (5) horsepower or greater, or that employs 7 or more, with, or without any machines, for manufacturing, producing, assembling, packing, repairing, maintaining, testing, improving, processing, conveying, storing, or destroying anything included in the classes or types of factories presented in Ministerial Regulations.

Factories are divided into 3 categories: Factories that don’t require a license, factories that only require notification in advance of the commencement of their operations (the operator may start the operation as soon as they receive a slip form from the Ministry informing them that their notification has been received), and factories that require a license from the Department of Industrial Works, Ministry of Industry, before the operation.

Factory License’s Owner Responsibilities

As a factory owner with a license, the operator must notify the competent authority(ies) at least:

• 15 days before the test run commences.
• 15 days before the actual operation.

Conditions of the License

• The license is valid for 5 calendar years from the year in which the business starts its operation.
  • Exceptions: The business relocates or the dissolution of the factory operations.
• The fees for the renewal of the Factory License depend on the size of the machinery and the horsepower. Once the expiry date is met, the Factory License must be renewed within 60 days. After the expiry date, the renewal application will be treated as a new application.
